Terms of Service
These Terms govern your use of PXEL Product Imaging, an AI product-visualization service ("PXEL", "we", "us"). By creating an account or using PXEL, you agree to these Terms. If you use PXEL on behalf of a company, you agree on its behalf and confirm you're authorized to do so. Questions: hello@pxel.app.
1. The service
PXEL lets you upload product photos and materials and generate new images (for example, new finishes, fabrics, angles and backgrounds) and 3D models, store them, and send them to connected services such as Shopify and Google Drive. Features may change as we improve the product.
2. Accounts
You're responsible for your account, keeping your credentials secure, and the activity of users you invite to your organization. Tell us promptly at hello@pxel.app if you believe your account has been compromised.
3. Your content
You keep all rights to the images, swatches and other material you upload ("Inputs") and, as between you and PXEL, to the images and models PXEL generates for you ("Outputs"). You grant PXEL a limited license to host, process and transmit your Inputs and Outputs only as needed to provide the service to you, including sending them to the AI and integration providers described in our Privacy Policy. We do not use your content to train AI models.
You confirm you have the rights needed to upload your Inputs and to use the Outputs as you intend, including rights in product designs, photos, fabrics, trademarks and any people shown.
4. AI-generated results
Outputs are created by AI and can contain inaccuracies — for example in color, texture, scale or details of a product or material. Review Outputs before using them, especially in product listings, and make sure they represent your products accurately. Similar requests may produce similar results for other users, and Outputs may not be eligible for copyright protection in every jurisdiction.
5. Acceptable use
Don't use PXEL to:
- infringe anyone's intellectual property, privacy or publicity rights;
- create deceptive, unlawful, hateful, sexually explicit or otherwise harmful content;
- misrepresent products in a way that would mislead customers;
- break the law or the terms of the AI and integration providers we use;
- probe, overload or interfere with the service, or access it other than through our interfaces;
- resell or provide the service to others without our written permission.
We may remove content or suspend access that violates these Terms.
6. Integrations
When you connect Shopify, Google Drive or another service, you authorize PXEL to act on your behalf within the permissions you grant, and your use of that service remains subject to its own terms. You can disconnect at any time in Settings › Integrations. We're not responsible for third-party services or changes they make.
7. Plans, billing and cancellation
Paid plans are billed in advance through Stripe and renew automatically each billing period until cancelled. You can cancel at any time; cancellation takes effect at the end of the current billing period and you keep access until then. Fees are non-refundable except where required by law or stated otherwise in a written agreement with us. Usage limits (such as credits, storage and catalogs) depend on your plan. We'll give at least 30 days' notice of price changes to existing subscriptions.
8. Availability and changes
We work to keep PXEL available and reliable but don't guarantee uninterrupted service. We may update, add or remove features. If we discontinue PXEL, we'll give reasonable notice so you can download your content.
9. Termination
You can stop using PXEL and close your account at any time. We may suspend or terminate access for violations of these Terms, non-payment, or to protect the service or other users. After termination, we may delete your content in line with our Privacy Policy, so download anything you want to keep.
10. Disclaimers
PXEL is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, non-infringement, and that Outputs will be accurate or error-free.
11. Limitation of liability
To the fullest extent permitted by law, PXEL will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill. PXEL's total liability for any claim relating to the service is limited to the amount you paid PXEL in the 12 months before the claim arose.
12. Indemnity
You'll defend and indemnify PXEL against third-party claims arising from your Inputs, your use of Outputs, or your violation of these Terms or the law.
13. Governing law
These Terms are governed by the laws of the State of Arkansas, USA, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Benton County, Arkansas, and you and PXEL consent to their jurisdiction.
14. Changes to these Terms
We may update these Terms. If changes are material, we'll notify account owners by email or in the app before they take effect. Continuing to use PXEL after changes take effect means you accept them.
